1. General Provisions

These Terms of Service ("Terms") govern your use of Nekoway, a privacy-focused VPN and security service ("Nekoway", "we", "us"), including our website, apps and subscriptions.

By creating an account, paying for a subscription, or otherwise using the Service, you confirm that you have read and fully accept these Terms. If you do not agree, you must stop using the Service.

You must be of legal age in your jurisdiction and able to enter into a binding agreement, and you may not use Nekoway where prohibited by applicable law or by sanctions that apply to you.

2. Nature of the Service

Nekoway provides an intangible digital service: an encrypted VPN connection with fast European routes, client apps (such as Happ and Hiddify) and an account dashboard, offered on a subscription basis. Features, apps and server locations may change while the Service is in beta.

Nekoway is focused on Europe. It is currently unavailable in Russia and has not been tested there; support for that region is not planned.

3. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "as available" basis.

We do not guarantee that the Service will meet your expectations, achieve any particular result, or operate without interruption; it may be affected by maintenance, network or hosting-provider issues, or abuse-mitigation measures.

To the maximum extent permitted by law, Nekoway is not liable for any direct, indirect, incidental or consequential losses, for the consequences of your actions, for the conduct of third parties, or for technical issues. You use the Service and make all related decisions independently and at your own risk. No VPN service can make illegal activity legal.

4. Lawful Use

The Service is not designed to encourage or enable unlawful activity. You must use it in accordance with all applicable laws and third-party rules, and you bear full responsibility for lawful use.

You must also comply with our Acceptable Use Policy. You may not use Nekoway for spam, phishing, malware, botnets, credential stuffing, account takeover, DDoS or other denial-of-service attacks, unauthorized access, unauthorized port or vulnerability scanning, copyright infringement, distribution of pirated or cracked software, child sexual abuse material, fraud, scams, harassment, illegal marketplaces, sanctions evasion, or any activity that violates applicable law.

5. Intellectual Property

All materials of the website, apps and Service are protected by intellectual-property law. You may not copy, distribute, resell or otherwise use them without permission of the rights holder. Violations may result in restriction of access without compensation.

6. Accounts, Suspension and Access Restrictions

You are responsible for keeping your account credentials secure and for activity carried out through your account; please notify us promptly of any unauthorized use.

We may suspend or terminate access for violations of these Terms or our Acceptable Use Policy, for identified abuse, or where required by law. Restriction of access does not release you from obligations incurred beforehand. We reserve the right to decline service to users who create elevated risk for the Service, our providers or third parties.

7. Payments and Refunds

Paid subscriptions are offered as non-renewing access plans that you renew manually before they expire. Payments are accepted through our payment provider: by bank card (Mastercard) or in cryptocurrency.

Payments are processed by a third-party provider. Nekoway does not store private keys, seed phrases or card numbers. Cryptocurrency transfers are usually irreversible, so when paying with crypto please verify the network, amount and wallet address before sending payment.

Because Nekoway is an intangible digital service delivered immediately, refunds are not provided once access has been granted, except where the service could not be delivered (for example, a technical fault on our side). Refund requests must be made within 24 hours of payment. New accounts can use the free trial to test the service first. Full details are in our Refund Policy. Please contact support@nekoway.app before initiating any chargeback, so we can resolve the issue directly.

8. Privacy and Confidentiality

We process only the minimal data needed to run and protect the Service, and we do not log your VPN activity. See our Privacy Policy and No-Logs Policy for details.

9. Changes to These Terms

We may modify these Terms from time to time. The current version is published on the Service, and continued use after changes take effect constitutes acceptance of the updated Terms.
